These general conditions of sale (hereinafter, "General Conditions") have as their object the regulation of the purchase of products and services, carried out remotely and made available, via the Internet, from the site www.foodinsicily.it (hereinafter, the Site) in compliance with Italian legislation on distance contracts (Legislative Decree 70/2003).

The Customer is required, before sending the order, to carefully read the General Conditions that have been made available to him on the Site to allow them to be reproduced and stored.
The contracts concluded with Food in Sicily by Sortino Filippo, through the Site are governed by these General Conditions in compliance with Italian legislation. The language available to conclude the contract is Italian

Choose and order the Products

The essential characteristics and prices of the Products are shown in the offer relating to each Product.
To purchase the Products, the Customer must complete the order form online and send it to Food and Sicily di Sortino Filippo in electronic format, following the instructions contained in the Site. The Customer must place the Product in the appropriate "cart" and, after having read the General Conditions, with particular reference to shipping costs, the methods of exercising the right of withdrawal, and the method of processing personal data, must select the desired payment method and choose the "Confirm order" option. Before submitting their purchase order, the Customer will have the opportunity to correct any errors in data entry by following the appropriate modification procedure contained in the Site. In particular, the Customer has the right to modify the quantity of the Products he intends to purchase, adding or eliminating one or more Products from the "cart". By sending the order, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions. The Customer will have the opportunity to view and follow the status of his order through the "Orders" area of ​​his account. Food and Sicily di Sortino Filippo reserves the right to evaluate the acceptance of orders received. Food and Sicily di Sortino Filippo will inform the Customer of any impossibility to accept the orders received within 30 days starting from the day following the day on which the Customer sent the order to Food and Sicily di Sortino Filippo and will refund any sums already paid by the Customer for the payment of the supply. In case a product is not immediately available Food and Sicily di Sortino Filippo will evaluate and/or propose replacement with a product having the same or superior characteristics.
If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Italian legislation regarding distance contracts.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by the failure to accept or fulfill, even partially, an order.
Food in Sicily by Sortino Filippo promotes the responsible consumption of alcohol and excludes any liability for purchases made by minors under 16 years of age.

Product Information
Information relating to Products susceptible to distance selling is available, with the relevant product codes, on the Site.
The visual representation of the products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics but may differ in color and size. In the event of a difference between the image and the written product sheet, the description on the product sheet always prevails.

Sale of alcoholic products prohibited to minors

In reference to the provisions of the art. 7 of Legislative Decree 158/2012, ban on the sale of alcoholic beverages to minors under the age of 18, Food in Sicily will verify, when ordering alcoholic products, whether the buyer respects the age limit set by the law. Otherwise you can cancel the order or remove the alcoholic products from the order with a refund of the difference.

Prices

Product prices are inclusive of all taxes and duties. All prices are expressed in Euros. Shipping costs are borne by the customer, except for any promotions and can be consulted on the shipping costs page.

Billing

The Customer may request the sales invoice at the time of the order, indicating the tax data and SDI code. In the presence of incomplete data or failure to request the sales invoice at the same time as the order,Food and Sicily di Sortino Filippo will not be able to issue a tax document and the related sale will be accounted for in the company's compensation register. It will not be possible to request sales invoices subsequently for orders already accounted for and fiscally registered.

Payment methods


The Customer may pay the price of the Products and the related delivery costs by credit card, PayPal or bank transfer.
Credit Card
The circuits on which it is possible to purchase within the Site are Visa, Mastercard and American Express.
To ensure maximum security, the Customer will carry out the payment transaction directly on the secure Paypal server.
The Site does not store the Customer's credit card number, but rather, thanks to the protected communication system of the relevant credit institution. The relevant credit institution uses the SSL protocol to encrypt the data transmitted between its server and the customer's browser.
In the event that, for any reason, the debiting of the amounts owed by the Customer proves impossible, the sales process is automatically canceled and the sale automatically cancelled.
PayPal Once the order has been confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his Paypal account or using a credit card, including a prepaid one. If you opt for payment by credit card, even prepaid, on the Paypal circuit, registration on the Paypal site is not mandatory.

Bank transfer
The Customer must make the bank transfer within 3 days from the date of the order. If this does not occur, Customer Service will contact him in order to clarify whether the cause of the non-crediting is due to the Customer's desire not to confirm the purchase or other causes.

Confirmation of receipt of the order

Once the order has been received, the Food in Sicily company of Sortino Filippo will check the availability of stocks to process the order. In the event that a product is not available, Sortino Filippo's Food in Sicily Customer Service will promptly notify the Customer. The Customer can decide whether to confirm the shipment or cancel it.
The Customer receives, at the time of execution of the contract, an email confirming receipt of the purchase order sent. The communication contains the order number, the summary of shipping and billing data, the list of products ordered with their essential characteristics, their price and the amount paid, as well as the data to make the payment if you have chosen the bank transfer method.

Transportation and delivery


The Products purchased on the Site will be delivered to the address indicated by the Customer. In any case, the Customer has the right to request delivery of the products to a natural person of his choice, whose residence or domicile is located within the Italian territory. At the time of delivery, the signature of an adult over the age of 18 will be required. Deliveries to post office boxes will not be made.
For each order placed on the Site, Food in Sicily di Sortino Filippo issues a receipt, or upon request an invoice, of the goods shipped, sending it via e-mail or post to the order holder, pursuant to the Presidential Decree. 445/2000 and Legislative Decree 52/2004. For the issuing of the invoice, the information provided by the Customer at the time of the order is valid. No changes to the invoice will be possible after it has been issued.

Delivery costs are borne by the Customer and are clearly highlighted on the Site and in the order form.

International shipping can be insured for a supplement of €10.00.

All purchases will be delivered by express courier chosen by the Customer during the purchase phase among those offered by Food in Sicily di Sortino Filippo (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Food in Sicily by Sortino Filippo is not responsible in any case for unforeseeable delays or for delivery delays by the courier.

Food in Sicily di Sortino Filippo will send the Customer a confirmation email once the Products have been shipped, which will specify the shipment tracking number through which it will be possible to view the status of the shipment, after entering it on the Courier's website. In any case, except in cases of force majeure or unforeseeable circumstances, in compliance with the Consumer Code the Products will be delivered within a maximum period of 30 (thirty) days starting from the day following the day in which the Customer sent the order to Food in Sicily di Sortino Filippo, unless Food in Sicily di Sortino Filippo communicates - within the same period, by e-mail - the impossibility of delivering the goods ordered following the unavailability, even temporary, of the Products. In the event of such communication, Food in Sicily di Sortino Filippo will refund any sums already paid by the Customer for the payment of the supply. In the event that, following notification from Food in Sicily di Sortino Filippo of a delay in the delivery date, the Customer wishes to cancel the Order, any amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from the day following the day on which the Customer sent the order to Food in Sicily di Sortino Filippo.

For the delivery of the goods, the presence of the Customer or his representative at the recipient's address indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or unaltered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately reported by means of a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of the delivered package.

The service includes 2 delivery attempts to the address indicated at the time of the order. After the second unsuccessful delivery attempt, the package will remain in free storage with the courier for 3 working days. During these 3 days the Customer can contact the Courier directly to arrange delivery or to change the delivery address. From the 4th day and for 7 working days (including Saturday), however, the package will be stored free of charge at the local Post Office. The Customer will receive information relating to the Post Office where to go for collection via paper notice left in the post office box and via email.

We would like to point out that the order processing and delivery times during Easter and Christmas due to operational slowdowns in all hubs and branches may therefore extend deliveries.are subject to possible delays or slippages compared to standard deadlines

We at Food in Sicily will do everything possible to ensure that all shipments are delivered on time. We would like to point out that the management of shipments from the moment they are entrusted to national and international couriers is beyond our responsibility and therefore Food in Sicily cannot be held responsible for any delays in deliveries.
