These general conditions of sale (hereinafter, "Terms and Conditions") govern the purchase of products and services, made at a distance and made available, via the Internet, from the site www.foodinsicily.it (hereinafter, the Site) in accordance with Italian legislation on distance contracts (D. lgs. 70/2003).

The Customer is required, before sending the order, to read carefully the General Conditions that have been made available on the Site to allow him to reproduce and store.
Contracts concluded with Food in Sicily di Sortino Filippo, through the Website are governed by these Terms and Conditions in accordance with Italian law. The language available to conclude the contract is Italian.

Choosing and ordering Products
The essential characteristics and prices of the Products are reported in the offer for each Product.
To purchase the Products, the Customer must fill out online and send to Food and Sicily di Sortino Filippo the order form in electronic format, following the instructions contained in the Site. The Customer will have to put the Product in the appropriate "shopping cart" and, after having read the General Terms and Conditions, with particular reference to shipping costs, the procedures for exercising the right of withdrawal, and the method of processing personal data, will have to select the desired payment method and choose the option "Confirm order". Before submitting his purchase order, the Customer will have the opportunity to correct any errors in data entry by following the appropriate editing procedure contained in the Site. In particular, the Customer has the right to modify the quantity of the Products he intends to purchase, adding or removing one or more Products from the "cart". By sending the order, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase process and fully accepts the General Conditions. The Customer will be able to view and follow the status of his order through the "Orders" area of his account. Food and Sicily di Sortino Filippo reserves the right to evaluate the acceptance of orders received. Food and Sicily di Sortino Filippo will notify the Customer of any inability to accept orders received within 30 days from the day following that on which the customer has sent the order to Food and Sicily di Sortino Filippo and will refund any amounts already paid by the customer for the payment of the supply. In the event that a product is not immediately available Food and Sicily di Sortino Filippo will evaluate and / or propose the replacement with product having equal or superior characteristics.

It is excluded any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance or evasion, even partial, of an order.
Food in Sicily di Sortino Filippo promotes the responsible consumption of alcoholic beverages and excludes any liability in case of purchase made by children under 16 years.
Information on Products Information on products that can be sold at a distance are available on the website, together with the relevant product codes.
The visual representation of the products on the Site, where available, normally corresponds to the photographic image accompanying the description. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics but may differ in colour and size. In case of difference between the image and the written product sheet, the description of the product sheet shall always prevail.
Sale of alcoholic products prohibited to minors
In reference to the provisions of art. 7 of DL 158/2012, prohibition of sale of alcoholic beverages to minors under 18 years, Food in Sicily will verify when ordering alcoholic products, if the buyer respects the age limit set by law. Otherwise it will proceed to the cancellation of the order or removal of alcoholic products from the order with a refund of the difference.
Prices
The prices of the products are inclusive of all taxes and duties. All prices are expressed in Euro. Shipping costs are charged to the customer, except for possible promotions and can be consulted on the page shipping costs.
Invoicing
The customer can request the sales invoice at the time of the order, indicating the tax data and SDI code. In the presence of incomplete data or failure to request an invoice of sale at the time of order,Food and Sicily di Sortino Filippo can not issue a tax document and the sale will be recorded in the register of receipts of the company. It will not be possible to request sales invoices later for orders already accounted for and fiscally recorded.
Methods of payment
The Customer can pay the price of the Products and the relative delivery costs by credit card, PayPal or bank transfer.
Credit Card

In order to guarantee maximum security, the Customer will make the payment transaction directly on the secure Paypal server.

In the event that, for whatever reason, the debiting of the amounts due by the Customer proves impossible, the sale process is automatically cancelled.
PayPal Once the order has been confirmed, the Customer will be redirected to the PayPal website where he can pay using his PayPal account or using a credit card, even a prepaid one. If you choose to pay by credit card, even prepaid, on the Paypal circuit is not required to register with the Paypal site.
In the event that, for any reason whatsoever, the debiting of the amounts due by the Customer proves impossible, the sale process is automatically cancelled.
Bank transfer The
customer must make the transfer within 3 days from the date of the order, if this does not occur will be contacted by Customer Service in order to clarify whether the cause of failure to credit is due to the desire of the customer not to confirm the purchase or other causes.
Confirmation of order receipt

Transport and delivery

All purchases will be delivered by courier chosen by the customer during the purchase process among those offered by Food in Sicily di Sortino Filippo (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays. Food in Sicily di Sortino Filippo is not responsible in any case for unforeseeable delays as well as delays in delivery by the courier.
Food in Sicily di Sortino Filippo will send the customer a confirmation e-mail once shipped products, which will specify the tracking number of the shipment through which you can view, after inclusion on the site of the Courier, the status of the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with the Consumer Code, the Products will be delivered within a maximum period of 30 (thirty) days from the day following that on which the customer has sent the order to Food in Sicily di Sortino Filippo, unless Food in Sicily di Sortino Filippo does not communicate - within the same period, by e-mail - the impossibility of delivering the goods ordered as a result of the unavailability, even temporary, of the Products. In the event that, against the communication of Food in Sicily di Sortino Filippo of a delay in the date of delivery, the Customer wishes to cancel the Order, any amount already paid by the same will be refunded as soon as possible, and in any case not later than 30 (thirty) days from the day following that on which the Customer has sent the order to Food in Sicily di Sortino Filippo.
For the delivery of goods is required the presence of the customer or his agent at the address of the recipient indicated in the order. Upon delivery of the goods by the Courier, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the package is intact or not altered. Any damage to the package and/or the Products or the mismatch in the number of packages must be immediately notified by means of a written control reservation on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer will not be able to contest the external characteristics of the package delivered.

The service provides 2 delivery attempts at the address indicated at the time of order. After the second unsuccessful delivery attempt, the package will remain in storage for 3 working days at the courier. During these 3 days the customer can contact the courier directly to arrange delivery or change the delivery address. From the 4th day and for 7 working days (including Saturdays), however, the package will be in storage free of charge at the Post Office in the area. The customer will receive information about the Post Office where to go for the withdrawal by paper notice left in the mailbox and by email.
